Very true, and one of the main reasons behind it is the Israeli lobby who do not mind this attack on human rights in the US as long as it is directed against Arabs and Muslims.
Allan Dorshowitz the Harvard law professor said what amount to saying, it is OK with him if the US use torture against the ME terrorist suspects it capture.
We have seen the new laws, which include jailing suspects without evidence,...if these laws were to affect Jews the law community and the Media would have attacked them and called them Fascist..., but they are not, and we know who control the Law and the Media.
What you said is true:
"presidents have been free to essentially declare any war they wanted so long as no one protested loud enough..." Well most of these wars have been against countries which Israel want war against, that is why your Democrat congressman from California Tom Lantos was more supportive of Bush war against Iraq than the Republican congressman (and so was Steven Solarz D-NY).
And even the none Zionist Congressmen even the one who "know better" they know where the money come from, and who control the media which control their future, and they vote accordingly.
Of course the Israeli lobby is not the only "Evil Doer", the Military Industry is another one which control the White House, and the congress, but at least it is an equal opportunity criminal, i.e. it promotes war against all people and all nations without much prejudice or discrimination.

: The simple voice of logic and reason.

: We have to stop buying American propaganda...thats all it is. We have to also be careful of what we mean when we say American. The Constitution gave Congress the authority to declare war. Since the Korean War that authority has shifted to the Executive Branch without any legal authorized action to change the Constitution... and presidents have been free to essentially declare any war they wanted so long as no one protested loud enough...and now that the same corporations that own the president own the media...it isnt hard to get the public to support a president when he is protecting our security. As a matter of fact many in Congress know better, but the tide of feeling, the power to manipulate the people is so great now that most Congresspeople are afraid to say what they know...or doubt, for fear the same mob will vote them out of a job...so they go along with the charade and Americans die too and people here are hurt as they are in Korea and Vietnam and Iraq and Afghanistan...and fifty five thousand die in the jungles of Vietnam and five thousand in the jungles of New York...and it matters not at all to the people who have hijacked America as surely as the terrorists allegedly hijacked Islam.
