BRENT A. WILBUR was born in Sioux City, Iowa, on May 17, 1949, and was raised in Elk Point, South Dakota. He received both his undergraduate and legal education at the University of South Dakota, receiving a Bachelor’s Degree Cum Laude in 1971 and a Juris Doctor in 1976. He is a member of Phi Beta Kappa. He was admitted to the Bar in 1976 and is also admitted to practice before the United States District Court for the District of South Dakota, the United States Court of Appeals for the Eighth Circuit, and the United States Supreme Court. Mr. Wilbur served as an Assistant Attorney General for the State of South Dakota from 1976 to 1978.

Mr. Wilbur is a member of the State Bar of South Dakota, serving as the president of the Young Lawyers Section from 1980 to 1981. He is also a member of the South Dakota Trial Lawyers Association, having served as president for 1986-87.
PROFESSIONAL EMPHASIS AND EXPERIENCE

Mr. Wilbur specializes in the area of criminal law, commercial law, lender liability, and creditor bankruptcy. He has represented large commercial lenders before the Bankruptcy Court for the District of South Dakota, including many commercial banks, insurance companies, and Farm Credit Services. Mr. Wilbur represents the South Dakota Cable Television Association, Northern Border Pipeline Company, and Farm Credit Services before the South Dakota Legislature. Mr. Wilbur is general counsel for the State of South Dakota Public Entity Pool for Liability and acts as legislative counsel to the Office of the Governor.

Mr. Wilbur has handled several hundred Chapter 11 and Chapter 12 bankruptcies for creditors at the trial court and appellate level. Several of those cases are frequently cited with regard to matters of bankruptcy law. Federal Land Bank vs. DeMers, 853 F2d 605 (8th Cir 1988). Mewes vs. BankWest, 58 BR 124 (D SD 1986). Mr. Wilbur successfully represented the First National Bank of Omaha in a multi-million dollar bank fraud and lender liability action. First National Bank vs. Zehringer and Pleasant Hollow Farms, Mr. Wilbur successfully represented Farm Credit Services of the Midlands, PCA, in a multi-million dollar bank fraud case in Fall River County, South Dakota. PCA vs. Chance Reynolds, Mr. Wilbur successfully represented Farm Credit Services in a multi-million dollar lender liability and bankruptcy matter. Jarrett vs. Federal Land Bank of Omaha, 128 BR 263 (D SD 1990). Mr. Wilbur successfully represented a court-appointed defendant with regard to a significant case interpreting the federal sentencing guidelines. United States vs. Alex One Star, 9 F3d 60 (8th Cir 1993). Mr. Wilbur has successfully represented a number of other criminal defendants charged with a wide variety of crimes in both state and federal court.

COMMUNITY ACTIVITIES

Mr. Wilbur is a former member of the South Dakota State Library Board and a member of the South Dakota State Centennial Commission. He is past state chairman of the Rocky Mountain Elk Foundation and currently sits on the board of directors of the Dakotah Chapter of Safari Club International.
