4 officers guilty in abuse case

One acquitted in 2002 incident

A federal court jury acquitted one Mt. Clemens police officer Friday and found four other officers guilty of charges resulting from the 2002 beating of a 24-year-old college student after a road rage incident.

The verdict, which came after 10 days of trial and more than two days of deliberations, left officers stunned, family members crying and lawyers bewildered about the jury's decision.

One juror, a 67-year-old retired Washtenaw County printer, said the decision was agonizing but straightforward.

"These guys got themselves into something that got out of hand," said the juror, who requested anonymity. "If they had just gone to the chief and told him what had happened, maybe they would have resolved it within the department and it wouldn't have wound up here."

Officer Patrick Carson was convicted of depriving Robert Paxton, 24, a University of Detroit Mercy graduate student, of his civil rights by beating him during a traffic stop.

Carson and Officer Robert Jacquemain were found guilty of conspiring to obstruct justice by writing false police reports and lying to the FBI about the incident. Carson and Peter Jacquemain were convicted of an additional obstruction count for writing false police reports. Robert Hey was convicted of obstruction of justice and perjury for lying to a federal grand jury about the incident.

Daniel Gerkey was acquitted of all charges.

Hey faces up to 20 years in prison, and the others face maximum 10-year terms. U.S. District Judge Nancy Edmunds said she will sentence the men in November. They are free on bond.

Defense lawyers wouldn't let their clients comment on the verdict.

Detroit attorney James Thomas, who represented Hey, said he may ask Edmunds to set aside the verdicts. Other lawyers said they might appeal after sentencing.

The incident happened around 10:30 p.m. July 27, 2002, after Paxton got into a traffic dispute with Hey, who was off duty and in his own vehicle and allegedly tried to run Hey off the road.

Hey called the police station on his cell phone and the other officers jumped into squad cars and joined the pursuit as Hey called in Paxton's location.

Witnesses testified that officers yanked Paxton out of his vehicle and punched and kicked him even though he put up no resistance. Prosecutors said the officers wrote false reports and had Paxton arrested on bogus charges.

Defense lawyers insisted that Paxton wasn't attacked, merely subdued.
