dude democracy or freedom of speech does not mean u insult people...

...dude, you're dead wrong. Larry Flynt, the publisher of Hustler Magazine "insulted" Jerry Falwell by printing an article which alleged, among other choice things, that the Rev. Falwell had oral sex with his own mother in an outhouse. What could be more "insulting" than that...right?

...Falwell sued Flynt and his magazine and won....the case was appealed by Flynt to the state supreme court and he lost again and was ordered to pay Falwell something like $800,000. Flynt appealed to the United States Supreme Court... and even with Justice Uncle Thomas Clarence sitting on it, he WON...the lower court verdicts were overturned...the court determined that SATIRE is an important part of our demcoracy, that it was clearly an absurd account of something that could not have happened and that as a public figure Falwell could not expect to be "protected"... they said that political satire, even when this outrageous, is an integral part of a VIGOROUS democracy, not your's...but then you don't have a country or a pot to piss in.

..it also means that the ONLY defense necesary against a charge of slander or libel is the TRUTH of your statements. Mexico has a democracy too but very different libel and slander laws...in Mexico you can PROVE that the person you called a liar really IS a liar...but that still won't get you off...not in America...if I call a woman a whore in America and can PROVE in court that she is...she has no legal claim against me. As you can see not all democracies are equal.

...I moved to Mexico before any lawsuit by Jackie Bejan...I also came back time and again, over a two year period, to appear in court to keep the proces going...I had every intention and DESIRE to go to trial...so did Jeff, whom she added to the suit...I made at least seven trips from Mexico to be present in court...representing myself...the last hearing set by the court was to select a trial date...one month before the court appearance to set that date, I received a letter from the court saying Jackie's lawyer had petitioned the court to be removed as her attorney...that she was not returning his phone calls etc. I was told there was no need for me to be present at that particular hearing...which was held in due course and the lawyer was allowed to remove himself...you can't just dump a client yourself....I few weeks later I received a letter from the court saying the suit against Jeff and I had been dropped due to Bajan's refusal to move forward. In other words SHE refused to fight.

I spent a good deal of time and money preparing for the case...there was nothing I wanted more than to see her on the witness stand...confronted by me and having to answer questions under oath...I knew damn well she would back out...no one wants to go to trial on THAT kind of ridiculous case....I was not surprised...just disappointed.

why not hang around and fight?????

...why not get on with my life...go sculpt on the beach...and come back to FIGHT every time there was a court date?
