2.1.3 Action against Professional Advisers

As previously reported, legal proceedings were commenced in late 2003 against
legal advisers to the company, Suzy David, Philip Pham, and others. The
proceedings are ongoing in accordance with the Court timetable. The claim against these parties is essentially a damages in negligence claim and it is anticipated that the matters will proceed to trial in the latter part of next year.

2.2 Karl Suleman
On 15 April 2004, Karl Suleman was sentenced in the New South Wales District
Court to 21 months imprisonment, with a non-parole of 12 months, in relation to 4 fraud charges brought by the Australian Securities and Investments Commission (“ASIC”). Karl Suleman was released from prison in relation to these charges in March 2005.
In May of this year, Karl Suleman pleaded guilty in the New South Wales District Court to a further 26 charges brought by ASIC and was remanded into custody. The Commonwealth Director of Public Prosecutions is prosecuting the matter and, while Karl Suleman remains in custody, as at the date of this report he has not been sentenced.
