Funny how this conservative whimp is crying now that HIS right to privacy has been stepped upon. Hello? Rush Seeks Higher Court Ruling

The undisputed hero of conservative political talk filed an appeal Thursday in Florida's 4th District Court of Appeal over a controversial ruling against him.

On Oct. 6, a three-judge state court panel ruled 2-1 that prosecutors investigating his use of painkillers had the right to examine his medical records.

But Limbaugh, who has not officially been charged in the case, and his lawyer, Roy Black, vehemently disagreed.

Black says the state court ruling was unfair and has wide-reaching implications for all Americans. "I think the decision was made in error…it directly contradicts a decision by the Florida Supreme Court (news - web sites) and a privacy ruling by this same court in 2002," the lawyer said in statement Thursday. "The outcome of this case will significantly affect everyone's right to doctor-patient confidentiality and medical privacy."

Black and Limbaugh are pressing for a rehearing of arguments by the same three-judge panel. In addition, they are seeking an additional review by the Florida Supreme Court.

In an odd coupling, the American Civil Liberties Union (news - web sites), frequent recipient of Limbaugh's rants, is siding with Black and Limbaugh.

The Florida chapter of the ACLU filed a friend-of-the-court brief in support of the 53-year-old Limbaugh.

Limbaugh's medical records were seized late last year.

Back on Dec. 23, 2003, a judge ruled that the records were taken legally. "The court knows of no less intrusive means to obtain the clearly relevant information than the methods the state employed her," the judge said, adding that the court "specifically finds that the state acted in good faith."

The records, according to Florida prosecutors, will only be examined by prosecutors and will not be released to the public or the press.

The medical records battle has begun to overshadow the blockbuster allegations in the case, first broken by the National Enquirer. Prosecutors allege that the famously pious radio host engaged in a bit of "doctor shopping"--that is, illegally gathering multiple prescriptions from different doctors--to feed an addiction to painkillers like OxyContin.

Prosecutors contend that Limbaugh's medical records will back up their assertion that the yakker received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion.

The gabmeister copped to an addiction to pain medication a year ago on his syndicated Rush Limbaugh Show. "I take full responsibility for my problem," he told fans.

Limbaugh, who has lobbied for harsh sentences for drug addicts, claims the accusations are "politically motivated."

After the scandal broke, Limbaugh took a five-week leave from his afternoon radio show to enter a rehab program.

Limbaugh told listeners at the time that he is "no role model."
